Acceptable Use Policy
1. Violations
Yuri Hosting reserves the right to place a fee on any account that violates what Yuri Hosting considers acceptable use as defined in
this document.
Any such fee will be described in Section 7 ("Fee Schedule") of the TOS.
2. Spamming
Sending unsolicited bulk and/or commercial messages over the internet ("spamming") is prohibited, regardless of whether or not it
overloads
a server or disrupts service to Yuri Hosting's customers. The term "spamming" also includes, but is not limited to,
maintaining an open SMTP
policy, engaging in spamming using the service of another ISP and referencing in the spam a web site
hosted on a Yuri Hosting server, and
selling or distributing software on a web site residing on a Yuri Hosting server that
facilitates spamming. Violators will be assessed a
fee as described in Section 7 ("Fee Schedule") of the TOS and will face
immediate suspension. Yuri Hosting reserves the right to determine, in its
sole and absolute discretion, what constitutes a
violation of this provision.
3. IRC
Yuri Hosting does not allow IRC servers, services, or bots to be operated on its network. Java IRC clients are permitted on its
network as long as they
connect to a server not hosted on Yuri Hosting's network.
4. Proxy Sites
Yuri Hosting does not allow proxy sites or any form of proxy to be operated on its servers or network.
5. Child Pornography
The use of Yuri Hosting's services to store, post, display, transmit, advertise, or other make available child pornography is
prohibited.
Yuri Hosting is required by law, and will, notify law enforcement agencies when it becomes aware of the presence of
child pornography
on, or being transmitted through, its services.
Yuri Hosting will not tolerate lolicon, shotacon,
hentai, or other forms of digital, rendered, or animated pornography that is made to look like a child.
6. System and Network Abuse
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network
security violations
include, without limitation, the following: unauthorized access to or use of data, systems or networks,
including any attempt to probe, scan, or test the
vulnerability of a system or network or to breach security or authentication
measures without express authorization of the owner of the system or
network; interference with service to any user, host, or
network including, without limitation, mail bombing, flooding, deliberate attempts to
overload a system and broadcast attacks;
forging of any TCP-IP packet header or any part of the header information in an email or newsgroup posting.
7. Viruses and Other Destructive Activities
Use of Yuri Hosting's services or equipment for creating or sending internet viruses, worms, or trojan horses, or for pinging,
flooding, or mail bombing, or
engaging in (distributed) denial of service ("DoS/DDoS") attacks is prohibited. It is also
prohibited for any customer to engage in other activity that is intended
to disrupt or interfere with, or that results in the
disruption of or interference with, the ability of others to effectively use Yuri Hosting's services and
equipment (or any
connected network, system, service, or equipment) or conduct their business over the internet.
8. Illegal Use
Yuri Hosting's servers and network may be used for lawful purposes only. Transmission, storage, or distribution of any information,
data, or material in
violation of any applicable law or regulation, or that may directly facilitate the violation of any
particular law or regulation is prohibited. This includes, without
limitation: copyrighted material; trademarks; trade secrets
or other intellectual property rights used without proper authorization; material that is obscene,
defamatory, constitutes an illegal threat, or violates export control laws.
9. Data Storage
Yuri Hosting's servers and network may not be used to facilitate in the acquisition, usage, or storage of illegal files or files that
violate the
TOS, AUP, or any referenced agreements. Prohibited files, without limitation, include warez, music, and movies
that are not owned or licensed by the customer.
10. SSH Access
Background processes are not permitted and resource usage must be monitored. There is no explicit resource limit at this time, but if
a customer is found
to be abusing SSH access, Yuri Hosting reserves the right to revoke the customer's access to SSH.
11. Free Hosting
To help reduce the potential for abuse and increase the overall service quality for all customers, Yuri Hosting will not allow
reseller customers to
provide hosting service to anyone for free.
Reseller customers may provide hosting service for any price
greater
than $1.00
USD. In addition, reseller customers may provide, for limited time as a
promotional offer, hosting service as low as $0.01 USD as long as a
clear and present expiration date is placed near the offer.
Reseller
customers may, at their discretion, provide free hosting service for a limited time to existing customers as a part of customer retention.
For
example: if the server goes down and a customer is angry, the reseller customer may provide that customer with one free month of service.
Yuri
Hosting may, on occasion, visit the website of each reseller account under its control and determine, based on their public
offerings, whether
or not
that reseller is providing free hosting service.
