Terms of Service

1. Agreement

All users of Yuri Hosting's services ("Services"), and all customers upon signing up for Services, agree to comply with Yuri Hosting's Terms of Service ("TOS").
The spirit of the TOS is to ensure customers are using Services with due regard to the rights of other internet users and in conformity with the requirements
of Yuri Hosting's network environment. The TOS supersedes any other Agreement with Yuri Hosting, whether written, oral, by conduct, or otherwise.

2. Renewal

Accounts are automatically renewed every month on the anniversary date of the account. The Customer is responsible for keeping billing information
accurate and up-to-date.

3. Payment

If you choose to pay by utilizing PayPal, you thereby authorize PayPal to conduct the transaction on Yuri Hosting's behalf.
If you choose to pay by utilizing Google Checkout, you thereby authorize Google to conduct the transaction on Yuri Hosting's behalf.

Yuri Hosting may also create periodic invoices for any applicable Supplemental Charges associated with your use of the Services. You agree to pay to
Yuri Hosting the amount indicated in each invoice by the due date reflected on that invoice. If you fail to pay any fees and taxes by the applicable
seven (7) days after the due date, late charges of 10% of the invoice amount before taxes shall also become payable by you to Yuri Hosting.

In addition, your failure to fully pay any fees and taxes within seven (7) days after the applicable due date will be deemed a material breach of this
Agreement, and Yuri Hosting may, in addition to any other remedy it may have:

Suspend its performance of the Services and/or terminate this Agreement
And/or, at the time of such nonpayment, Yuri Hosting may delete any and all content from the Yuri Hosting servers

Any such suspension or termination of the Services would not relieve you from paying past due fees.

All payments must be submitted to Yuri Hosting in USD ($).

4. Suspension

An account may be suspended for any of the following violations:

Account is seven (7) or more days past due
Resource (CPU, RAM, etc...) abuse
TOS violation
Any act or usage of services determined to be an immediate danger to other customers or internet users

Removal of suspension will occur when the account in question has been paid in full and any remaining violations have been remedied.

Yuri Hosting reserves the right to refuse removal of suspension to any account at their sole discretion if they find that it would be of further
danger to other customers or internet users.

Yuri Hosting reserves the right to place a reconnection fee or any other fee it deems necessary on the account in question if the fee is detailed in
Section 7 ("Fee Schedule") of the TOS. If Yuri Hosting chooses to exercise this right, the customer must pay all associated fees before the
removal of suspension will occur.

Yuri Hosting reserves the right to erase all customer data once the account has been suspended for a period of thirty (30) days.

Yuri Hosting does not issue refunds for any amount or reason for accounts that are suspended.

5. Termination

An account may be terminated for any of the following violations:

Account is thirty (30) or more days past due
TOS violation
Any act or usage of services determined to be an immediate danger to other customers or internet users

Yuri Hosting is not liable for loss of data or service due to termination. Once an account has been terminated, it is completely removed from our servers.
We may still keep your customer information on file for record keeping purposes.

6. Cancellation

Cancellation requests must be made at least twenty-four (24) hours before the renewal date.

Cancellation requests must be made by logging into the client area, select "My Products & Services", select the product or service to be
cancelled (click the icon next to it), and select "Request Cancellation". Cancellations placed using any other method will not processed
and may result in continued service.

Upon cancellation, a prorated refund will be granted within 15 days for refunds totaling <= $50.00 USD, 30 days for refunds totaling
between $50.00 and $100.00 USD, and 45 days for all other refunds.

7. Fee Schedule

Yuri Hosting reserves the right to place additional fees onto your account if, and only if, the fee is detailed in this section of the TOS.

Yuri Hosting may not always assess these fees. Yuri Hosting will act in good judgement while assessing these fees but will do so at its sole discretion.

The fee schedule is as follows:

SPAM Fee - $200.00
Late Fee - 10%

Percentages are measured as a percentage of the total cost of the invoice in question.

8. Backups

Yuri Hosting performs secure nightly, weekly, and monthly backups of every account. Yuri Hosting is not responsible for the verification
or the availability of these backups.

Customers are ultimately responsible for the backup and verification of their data. Yuri Hosting's backups are to be considered an extra
precaution and not a crutch.

Yuri Hosting encourages all customers to download and verify a backup of their data at least once a week to their home computers.

9. Indemnification

Customer agrees that it shall defend, indemnify, save and hold Yuri Hosting harmless from any and all demands, liabilities, losses, costs and
claims, including reasonable attorney's fees asserted against Yuri Hosting, its agents, its customers, officers and employees, that may arise
or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns.
Customer agrees to defend, indemnify and hold harmless Yuri Hosting against liabilities arising out of; (1) any injury to person or property
caused by any products sold or otherwise distributed in connection with Yuri Hosting; (2) any material supplied by customer infringing or allegedly
infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers by Yuri Hosting.

10. Disclaimer

Yuri Hosting shall not be responsible for any damages your business may suffer. Yuri Hosting makes no warranties of any kind, expressed or implied for
services we provide. Yuri Hosting disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from
delays, no deliveries, wrong delivery, and any and all service interruptions caused by Yuri Hosting and its employees.

11. Amendments

Yuri Hosting's content including, without limitation, the TOS and all referenced documents and pricing structure are subject to change.

Yuri Hosting reserves the right to modify the TOS, all referenced documents, the web site, pricing structure, and any other data, object, entity, or
manifestation owned by Yuri Hosting. Modification can be done at any time and without prior warning.

Amendments to the TOS, all referenced documents, the web site, pricing structure, and any other data, object, entity, or manifestation owned by
Yuri Hosting will take effect immediately upon the posting of such Amendment to the Yuri Hosting web site.

Yuri Hosting is not required to give notification of such Amendment to any customer. It is the customer's responsibility to check all applicable documents
often for change.

Yuri Hosting will make every effort possible to notify each customer of such Amendment above and beyond what is required.
